Medical Reimbursement--Non-Empanelled Hospital-- Denial of Medical Reimbursement for Treatment at Non-Empanelled Hospital Unjustified When No Treatment Facility Exists Within State
Reimbursement of medical expenses incurred at a non-empanelled private hospital outside the State cannot be denied on technical grounds when no treatment facility for the ailment is available within the State or in Government hospitals. A Government employee's entitlement to medical reimbursement must be considered sympathetically in such circumstances, and rejection based solely on empanelment status amounts to an unjust application of administrative circulars.
