POCSO--No Injury on Private Parts--Absence Of Hymen Rupture Or Vaginal Injury Does Not Negate Penetration Under Section 3(a) Of POCSO Act

Hymen rupture or vaginal injury is not an essential ingredient to prove penetrative sexual assault under Section 3(a) of the Protection of Children from Sexual Offences Act, 2012. Penetration can occur without rupture of the hymen, and absence of vaginal injury does not negate penetration. Any act of manipulation of any part of the body of a child so as to cause penetration into the vagina falls within the definition of penetrative sexual assault under Section 3(a) of the POCSO Act.
