Termination -- Suppression of Material Facts --Non-Disclosure of FIR Cancelled Before Recruitment Does Not Constitute Suppression of Material Fact Warranting Termination
Non-disclosure of an FIR cancelled by judicial order before the recruitment process commenced does not amount to suppression of a material fact justifying termination. Relying on Avtar Singh v. Union of India (2016), suppression must be evaluated contextually, considering the nature of the allegation, outcome of the criminal case, timing, and candidate's suitability.
