Injunction -- Interim Injunction -- Co-sharers in Joint Property
Where a co-owner is in exclusive possession of a specific portion of jointly held land, such co-owner is entitled to seek interim injunction against interference by other co-sharers. No co-sharer has the right to alter or change the character of the portion which is under the exclusive possession of another co-sharer. An application for interim injunction filed on such grounds was rightly allowed -- CPC, O.39, Rr.1 & 2
